Join representatives of the Appellate Team from the Florida Statewide  Guardian ad Litem Program as they provide explanations about certiorari petitions with the following key take-a-ways: 

    • Certiorari allows higher court to review the proceedings for regularity before a final order is entered. 
    • A Certiorari review functions as a safety net.
    • Examples of when certiorari are used included changes of placement, reunification and the modification of case plans or visitation. 
    • There are 30 days to file the full petition from rendition of the written order.
    • If time line to file the full petition is missed, it cannot be fixed. 
    • The burden of certiorari proceedings is high and argument must be based on more than legal error.
