This presentation defines judicial notice, provides an overview of the statutory framework governing its use, and explains how judicial notice can be an easier alternative to proving the facts of a case. 

This presentation defines judicial notice, provides an overview of the statutory framework governing its use, and explains how judicial notice can be an easier alternative to proving the facts of a case.  

Specifically, the elements of several statutory TPR grounds are reviewed to determine those suitable for proof by judicial notice.  

Best practices are also discussed for requesting and justifying judicial notice, both before and during trial.  

Finally, common pitfalls are explored, especially regarding the limits of judicial notice and the importance of making a proper record for appellate review.
